Johannesburg - The Special Investigative Unit (SIU) says it intends to institute civil proceedings against former Eskom contracts manager Duduzile Moyo who was this week slapped with a preservation order of R24 million of her pension fund.
Moyo is reported to have made a series of payments to Tamukelo, a company that was contracted to transport potable water to Kendal and Kusile Power stations.
The Special Tribunal order dated September 28, 2022, has interdicted Moyo's pension fund and provident fund from paying out the former Eskom contracts manager who resigned early this month following the investigation into her conduct. SIU spokesperson Kaizer Kganyago said the investigation into Moyo's conduct found she acted improperly and flouted Eskom's supply chain management policies when she signed the Tamukelo contract.
“The SIU investigation into Moyo's conduct found Moyo in her role as Eskom supply chain manager and contracts manager contracted a business named Tamukelo. Tamukelo was appointed to transport raw and potable water from Kendel to Kusile power stations. In her position as contracts manager, Moyo signed 23 interim payment certificates in respect of Tamukelo's services for the period December 2011 to July 2014 totalling approximately R138 million,” Kganyago said.
Kganyago added that the SIU probe had revealed that Tamukelo and its representatives paid entities linked and associated with Moyo, while she negotiated and managed Eskom's contracts with Tamukelo.
“The modus operandi employed by Moyo was to create structures of entities owned by members of Moyo's families and friends to receive these funds. There was a clear conflict of interest in that, she received these funds in circumstances where part of her duties and functions as middle management she was part of a team that represented the negotiations strategy of the Tamukelo tender and procurement committee,” Kganyago said.
According to the SIU Moyo also deceived Eskom as she repeatedly made fraudulent misrepresentation by declaring that there was no conflict of interest with Tamukelo and other role players for a period of five years.
“Moyo deceived Eskom and repeatedly made fraudulent misrepresentation of her situation and by declaring that there was no conflict of interest when there was. The SIU intends to expeditiously institute civil proceedings against Moyo, 30 days after the conclusion of this interdict,” he said.
